Okay, that's not the case today, but it could be soon if a bill in the Wisconsin legislature passes. Right now, Wisconsin has a partial helmet law where people who are under age 18 and riders with learners permits are required to wear them.

Many other states require drivers to wear them including the state famous for celebrity riders and Hells Angels (California if you didn't get my hint). Before 1976, Wisconsin had a similar law. It was repealed by the legislature.

I think a better solution is to create a law where riders automaticall waive all rights to sue in court for liability claims when involved in an accident and not wearing a helmet. These careless people should also pay much higher health insurance rates as well as auto insurance rates.

I don't want to force these people to wear helmets by law because they're relatively stupid people to begin with. That's why I don't mind having their brains splattered on a highway. I just don't want to pay for it.

I think you need to prevent accidents through education, public awareness and share the road programs. Not by making crashing safer, prevent the accidents to begin with.

My first time commenting on a fox news blog, so even though I thought I commented already, this issue is important enough that I will comment again. A helmet law is not the answer. The government has proved this countless times but refuses to reference it's own statistics. States that have recently reistated their helmet laws such as Louisiana have actually seen an increase in motorcycle fatalities. Although it's been proven time and time again that education and awareness are the best way to lower fatality rates, Wisconsin only spent slightly more last year on it than it did ten years ago. Even though we have doubled motorcycle registrations in that same time period. Where does the money go. Maybe that's what we should be asking them. ABATE of WI puts out more awareness material every year than our own DOT. See a problem with that? Bikers helping out themselves? By NHTSA's own statistics, a helmet would have only helped in less than forty percent of fatal crashes last year. Upper chest and lower trunk trauma are the largest factor in motorcycle fatalities and injuries. No helmet manufacturer even guaranties their helmets. You can still get a concussion wearing a helmet. It is not the silver bullet or the suit of armor. Even beyond the crash statistics of helmets, is the basic right and civil liberty to have every motorcyclist make their own choice. Anyone who has ever ridden a motorcycle knows that they are inherently dangerous. But should the government make our choices for us or should we, as free Americans, be able to make our own choices? I'll sign a waiver if all smokers, drinkers, and drug addicts will do the same. Calling bikers stupid shows your intelligence. Most motorcylists go through extensive training to get their license. What they don't teach us is how to react to an intentive driver who does not respect the 2 second rule.

And, to A Jive Soul Bro- Motorcyclist don't always crash by themselves. And currently the fine for pulling out in front of and killing a bikers is less than a hundred dollars. It's normally not our brains scattered on the highway but our limbs, and normally a bleed out follows. But, if no helmet was on, they list those as helmetless fatalities. Don't buy into the b.s. you read. Bikers are people too. And, I already pay more for health and vehicle insurance. Last time I checked this didn't affect your stupid, ignorant self one bit.

Education?!

Chubbs- These people cannot be educated. Most are dumb as rocks. They get rear ended due to their wrecklessness and then sue the person who hit them and take their house and other assets because their injuries are much worse.

The law should not change, it should remain my choice as to if and when I wear a helmet. I've been riding for 24 years and although I prefer not to, I do sometimes wear a helmet depending on the weather or my destination.

If Wisconsin passes a mandatory helmet law I will either sell my bike and quit riding or move to another state where I can ride how I want to.

harleygay- you have not addressed any of my response. Why should someone be prosecuted for your incompentence and your decision to drive on a highway and leave yourself vulnerable? It's not even worth scrping your brain off of the pavement. I'd rather they remove deer remains.

This is in reference to what A_Jive_soul_bro had to say …………..Where are the bikers rights when some dumb idiot runs a red light and hits a biker head on and claims He / she didn’t she him/her……….because it does happen……I have tried wearing a half helment and It interferes with getting better vision when needing to change lanes.Wanna Talk about stupid people ? The people in 4 wheels feel safe enough to talk on phone, do their makeup, text people and they do not pay attention to the people around them. And for us bikers we are always looking to avoid some one like you and always looking around us to make sure we are in no danger. Besides a helmet will not save a broken leg, arm ,neck or back which will get injured before a brain gets splattered …..and for us riders we still get back on and ride!!!!!

How many more decisions will be made for us?
As a citizen of a “free” country, I do believe I am capable of and have the right to make this decision on my own. This is a decision that will only affect me, and it doesn’t need to be made for me.

As already stated, let's prevent the crashes through education, public awareness and share the road programs. Not by making a crash safer, prevent the crash to begin with. ABATE of Wisconsin will get anyone interested, the information needed to find a "Share the Road" program in their area.

AJSoBro - You really are a moron, you quote no statistical data or facts, just an ignorant opinion.

By the way, health insurance rates are not affected by whether you ride a motorcycle or not, unless you are racing one at a track. Also, you do not buy auto insurance for a motorcycle. You buy auto insurance for an automobile and motorcycle insurance for a motorcycle. Motorcycle riders pay plenty for insurance.
