Mark Benson -- the 55-year-old former doctor accused of a fatal OWI crash that killed an Oconomowoc school administrator, her daughter, and unborn child -- was in court yesterday. 

In setting $1 million bail, Waukesha County Circuit Court Commissioner Martin Binn said, "This court will not, it cannot allow him to play Russian roulette with the lives of the citizens of Waukesha County when he gets behind the wheel of a motor vehicle."

Tough talk -- but a few days too late.

On April 23rd, Waukesha County Circuit Judge Lee Dreyfus sentenced Benson for OWI 3rd offense.  He had the opportunity to lock him up on the spot, but instead chose to give him time to report. 

In other words, he allowed Benson to play "Russian Roulette." 

Benson is accused of pulling the trigger one more time, driving while under the influence of three prescription drugs.

This time, the chamber was full.

Wow....THEE Lee Dreyfus? Our old Governor's son?
I am shocked. You would think he'd know better.
It's time to get tough with people that have addiction problems. Alcohol is a terrible drug that has been ignored way too long. Whatever their problems are that cause them to drink have to be addressed. It will be better for them and us in the long run.

That Lee Dreyfus.

To be clear, Mark Benson was NOT drunk on alcohol. He is alleged to have been intoxicated on a cocktail of prescription drugs (the kinds of drugs he lost his medical license for obtaining illegally).

Thanks. Either way, addiction is a terrible thing that takes over a life.
Were his other convictions for alcohol or drugs?
If we want to slowdown the problems with drugs and alcohol then we have to get help for the people that abuse them. It would mean less crowding in jails and addicts becoming productive citizens.

How many major offenses are their in driving when it comes to drugs and alcohol intoxications? The only ones I'm aware of are DUI (Driving Under the Influence) and OWI (Operating While Intoxicated)? Which One Is Worse or Are They Both Just As Bad That It Can Give You The Same Time Behind Bars?

Dreyfus JR sentenced a guy my husband works with-- 90days w/work release FOR HIS 3rd DUI!!Oh and allowed this bozo to attend a "trade show" in Chicago while IN THE WAUKESHA HUBER FACILITY!! ALMOST FORGOT - THE A-BUTT EVEN HAS AN OCCUPATIONAL DL!!!! ALL PER Jr.
(this was less than a month ago)The kicker being.....this low life just got fired for smelling of alcohol at 7 AM last Thur!!!!! So he must have had a few drinks driving to work!!
GOOD WORK JUDGE DREYFUS - AND THATS NO COMPLIMENT!!!!

O1Antoine -- GREAT QUESTIONS, now we just need answers! For some reason I think they may be the same but I dont know. Hopefully someone will post the answer. I too would like to know the difference!! Either way I think all us bloggers need to get together and try to get these laws changed from a slap on the wrist to the sound of bars SLAMMING SHUT!!! I just dont know how to go about it!! Im actually afraid to drive later at night and I HAVE THE PRIVILEGE TO BE ON THE ROAD - NOW IM EVEN MORE SCARED TO BE ON THE ROAD SINCE A DRUNK DRIVER RAN MY FAMILY OFF THE ROAD LAST SAT. NIGHT!!The
Police told us it was his 3rd DUI -- Im just glad they got him - Oh and the piece of BLEEP has no insurance so WE HAVE TO PAY FOR THE DAMAGE TO OUR TRUCK (we didnt tell the insurance co. 'cuz we didnt want our rates going up but still this drunk cost us $312 BUT my Family is ALIVE and NO PRICE FOR THAT!!!

How absolutely disgusting! To think this jerk swore on the "Hippocratic Oath"!! I can see why he is no longer in practice. This guy needs some serious help. Help he should have gotten before he took the lives of 3 innocent victims!

This is sad. However it goes to show that our judges have no concern as to what is the proper way to go about putting someone who truly deserves to be put behind bars. Just let's hurry and give him a slap on the wrist. Now he killed 3 people and they're finally going to do something about it. This is how sad our society really is!

he should at least spend the rest of his life behind bars even longer for killing the unborn baby, the mother, and her daughter that were in the car. i did agree with the judge when he was on the news saying that he just cannot let jensen play with the lives of waukesha county. as always, bryan_polcyn, great job on the posting of this blog. great job and keep up the great work!!!!!

UPDATE!! Folks I mentioned an idiot my husband worked with above....Turns out Mgt. called the police as he was pulling out of the parking lot
after being fired for smelling of alcohol......

.28 THATS WHAT 3x LEGAL LIMIT??

WERE SAFE FROM 1 NOW - HE RELAXING IN WAUK. CO

Okay, OWI and DUI are different.

OWI- (Operating while intoxicated) is usually cited when a person in sitting in their vehicle and they have the keys in the ignition Whether the car is running or not.

DWI- (Driving while intoxicated) Means Alcohol intoxication above the legal 0.08 limit.

DUI- (Driving Under the Influence) Means driving while under the influence of drugs.

I look forward to watching your news article this evening. I am a retired Milwaukee Police Sergeant and worked worked the streets of Milwaukee over 25 years. DUI's were, in my opinion, on the bottom of the food chain for City Attorneys and District Attorneys. They seemed to want to prosecute the "Bigger crimes." How much bigger can this problem get?



I never understood why a violator was slapped on the hand for killing a person while driving intoxicated vs. killing someone with a weapon. In Milwaukee County if you want to get away with murder, kill them with a motor vehicle while your drunk and walk away squeaky clean.



Just my opinion, take it for what it is worth. I am sure you talked to everyone concerned to compile this story.Thanks for listening and enjoy your day.
